Fundamental Rights of Pakistani Citizens: Know Your Constitutional Protections

An overview of the fundamental rights guaranteed under the Constitution of Pakistan and how to enforce them.

The Constitution of Pakistan, 1973, guarantees fundamental rights to all citizens. Understanding these rights is essential for every Pakistani to ensure they are protected against arbitrary state action.

Part II, Chapter 1 of the Constitution enshrines these fundamental rights:

Right to Life and Liberty (Article 9) No person shall be deprived of life or liberty except in accordance with law. This includes protection against arbitrary detention and extrajudicial actions.

Safeguards Against Arrest and Detention (Article 10) Every arrested person must be informed of grounds of arrest, allowed to consult a lawyer, and produced before a magistrate within 24 hours.

Right to Fair Trial (Article 10A) Every person is entitled to a fair trial and due process. This includes the right to be heard, present evidence, and receive a reasoned judgment.

Freedom of Movement (Article 15) Citizens have the right to move freely throughout Pakistan and reside in any part of the country.

Freedom of Assembly (Article 16) Citizens have the right to assemble peacefully without arms, subject to reasonable restrictions.

Freedom of Speech (Article 19) Every citizen has the right to freedom of speech and expression, subject to restrictions in the interest of Islam, security, or public order.

Freedom to Practice Religion (Article 20) Every citizen has the right to profess, practice, and propagate their religion.

Right to Property (Article 23) Every citizen has the right to acquire, hold, and dispose of property, subject to law.

Enforcement Through Courts: Article 199 empowers High Courts to enforce fundamental rights through constitutional petitions. The Supreme Court has original jurisdiction in matters of public importance involving fundamental rights.
