LEGAL REPRESENTATION AT THE APEX COURT

January 1, 19705 min read
At M.A.K. TANOLI & CO., we believe that the rule of law is strengthened when public offices remain subject to constitutional scrutiny and accountability. Our commitment to protecting constitutional rights and promoting transparent governance continues to guide every matter we undertake.
We are pleased to share a significant development in one of our ongoing constitutional cases, led by our Founder & Senior Partner, Muhammad Arshad Khan Tanoli, Advocate Supreme Court of Pakistan.

Case Background

The matter concerns appointments made at the National Institute of Cardiovascular Diseases (NICVD), which were challenged through a Constitutional Petition in the nature of Quo Warranto. The petition questioned the legality of the appointments on constitutional and statutory grounds.
Following the dismissal of the petition by the High Court, without addressing the principal legal issues raised, our legal team pursued the matter before the Federal Constitutional Court, Karachi Registry, by filing a Federal Constitutional Petition for Leave to Appeal (F.C.P.L.A.).

Proceedings Before the Federal Constitutional Court

The petition came before a two-member Bench of the Federal Constitutional Court. After hearing preliminary submissions from our counsel, the Court found the matter worthy of consideration and issued notices to the respondents, directing that the case be fixed for hearing in the forthcoming session.
While the proceedings remain pending and no final determination has yet been made, the issuance of notices reflects the Court's willingness to examine the constitutional questions raised in the petition.

Our Commitment

Constitutional litigation plays a vital role in ensuring that public authorities act within the limits prescribed by law. At M.A.K. TANOLI & CO., we remain committed to pursuing matters that promote accountability, transparency, and adherence to constitutional principles.
For our team, particularly our young lawyers, appearing before the Federal Constitutional Court provides invaluable experience in advocacy at the highest constitutional forum. Every appearance contributes to our professional growth while reinforcing our dedication to excellence in litigation.
We remain grateful to our clients for their trust and look forward to continuing our efforts in advancing the rule of law through principled and effective legal representation.
